TwitFS Terms of Service:

By signing up for a TwitFS account you agree that you have read, understand its contents, and agree to all terms and conditions. Should you have any questions concerning this Agreement, please contact feedback@twitfs.com.

These terms and conditions are between the user and TwitFS, governing the use of TwitFS's services.

Restrictions.

You are permitted to store, control, examine, reformat, print, and display the content only for your personal use. Unauthorized use of the service, or the resale of said service without TwitFS's prior written consent, is expressly prohibited. You shall not copy, license, sell, transfer, transmit, make available, distribute, publish, or assign this license or the content in any format to any third party.

All transactions using TwitFS's services are between the transacting parties only. TwitFS is not an agent of any transacting party, nor is it a direct party in any such transaction. Any such activities, and any terms, conditions, warranties or representations associated with such activities, are solely between you and the applicable third-party. TwitFS shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between you and any such third-party.

TwitFS does not endorse any sites on the Internet that are linked through TwitFS. TwitFS is providing these links to you only as a matter of convenience, and in no event shall TwitFS be responsible for any content, products, or other materials on or available from such sites.

You will choose a personal, non-transferable password. User accounts cannot be "shared" or used by more than one individual.   In addition, you acknowledge that TwitFS may communicate with you through email. You are responsible for ensuring that TwitFS has your current email address so that TwitFS can provide you such communications. You are responsible for maintaining the confidentiality of your password. You are also responsible for all content and information stored, transferred, and received under your username and password. If you suspect a person has accessed your account without authorization, it is your responsibility to change your password and alert TwitFS immediately.

TwitFS does not own any data, information or material that you submit or store in your account, and takes no responsibility whatsoever for the contents of your account. TwitFS will not monitor, edit, or disclose any information regarding you or your account, including any data, without your prior permission except in accordance with this Agreement. Please be aware that TwitFS does provide certain user registration and statistical information such as usage or user traffic patterns in aggregate form to third parties but such information will not include personally identifying information. Your Internet protocol address is not transmitted with each message sent from your TwitFS account. TwitFS may access your account, including its data, to respond to service or technical problems or as stated in this Agreement. You, not TwitFS, shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness and copyright of all data and TwitFS shall not be responsible or liable for the deletion, correction, destruction, damage, loss or failure to store any data.

TwitFS offers its service, as described on the TwitFS website (www.twitfs.com) and as published within the Service, for monthly or annual fees, which you will pay to TwitFS by authorized credit card or Paypal. The fees applicable for TwitFS service are available at www.twitfs.com and as published within the service. TwitFS reserves the right to change the Fees or applicable charges and to institute new charges at any time, upon thirty (30) days prior notice to you (which may be sent by email to the address you have most recently provided us).

You are solely responsible for the content of all data you store or retrieve from your account and from all public folders. You agree to abide by all applicable local, state, national and international laws and regulations in connection with TwitFS service. In addition, without limitation, you agree not to use TwitFS service to: (a) send unsolicited or unauthorized junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (b) advertise or promote a commercial product or service that is not available through TwitFS's services; (c) harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent; (d) store, retrieve, transmit or view any file, data image or program containing: (i) unlawful, abusive, defamatory, threatening, harmful, vulgar, pornographic, abusive, libelous, obscene or otherwise objectionable material of any kind or nature; (ii) any material that encourages conduct that could constitute a criminal offense; (iii) any code or material that violates the intellectual property rights or rights to publicity or privacy of others; (e) transmit any material that contains software viruses or other harmful or deleterious computer code, files or programs such as trojan horses, worms, time bombs, or cancelbots; (f) interfere with or disrupt servers or networks connected to TwitFS service or violate the regulations, policies or procedures of such networks; (g) access or attempt access to TwitFS service, other accounts, computer systems or networks connected to the Service, through password mining or any other means; or (h) harass or interfere with another user's full use and enjoyment of TwitFS service. You will not abuse our system or our system resources (i.e. bandwidth). Users who generate very excessive traffic may need to arrange a custom file hosting plan.

You will not use the Service to send chain letters, unsolicited commercial email (also known as spam), junk email, or other unsolicited messages; transfer any material that is protected by any patent, trademark, trade secret, copyright or other proprietary rights of any party unless you have sole ownership over that material or have received all necessary consents to distribute that material; transmit files that contain viruses, Trojan horses, worms, corrupted files, or any other software, programs, or code that may damage the operation of another's computer or the data or property of another (Virus); or transmit any material that is harmful to minors.

TwitFS reserves the right to terminate your password, account or use of TwitFS service and delete any data within TwitFS service if you fail to comply with this Agreement. You may terminate your user account upon notice to TwitFS at any time; however, you will not receive a refund of any portion of your fees paid to TwitFS. Upon termination by TwitFS or at your direction, you may request a file of your data, which TwitFS will make available for a fee. You must make such request at the notification of termination to receive such file within (30) days of termination. TwitFS shall have no obligation to maintain any data stored in your account or to forward any data to you or any third party.

Except for the licenses granted herein, you have no right, title or interest in or to TwitFS service or any content. You agree that TwitFS or its licensors retain all proprietary right, title and interest, including copyright and all other intellectual property rights, in and to TwitFS service and content, including, without limitation, text, images, and other multimedia data. TwitFS and/or other TwitFS products and services referenced herein are either trademarks or registered trademarks of TwitFS.

You agree to indemnify and hold TwitFS harmless from and against any and all claims, costs, damages, losses, liabilities, and expenses (including, without limitation, attorneys' fees and costs) resulting from or in connection with your use of TwitFS services or breach of this Agreement.
